Yorktown Heights woman wins $2M malpractice verdict in gender-affirming surgery case

A legal first that could reshape gender medicine happened right here in Westchester.

A New York State jury found medical professionals liable for malpractice in a case involving gender-affirming surgery on a minor. The suit was filed by 22-year-old Fox Varian of Yorktown Heights.

The six-member jury in Westchester County Supreme Court ruled against psychologist Kenneth Einhorn and surgeon Simon Chin after a three-week trial, awarding Varian $2 million—$1.6 million for past and future pain and suffering and $400,000 for future medical expenses, according to reporting from the New York Post.

Varian, who was 16 at the time and assigned female at birth but identified as male, underwent a double mastectomy. She later came to regret the surgery and now identifies as female, a process known as detransitioning—highlighting the complex and debated issues surrounding gender-affirming care for minors.

The verdict, first reported by the Free Press, is the first malpractice ruling against providers of gender-affirming care for minors and has drawn national attention, potentially influencing future cases and medical practices.
