The Yorktown man accused of raping a resident with severe dementia at the Yorktown Rehabilitation and Nursing Center is scheduled to return to Westchester County Court Sept. 22, as the case remains pending, according to the Westchester County District Attorney’s Office.
The 48-year-old former housekeeper, Javier Barragan, was arrested in February and charged with felony offenses, including second-degree rape and first-degree endangering the welfare of an incompetent or physically disabled person.
According to the District Attorney’s Office, a nursing assistant discovered the alleged incident around 7 a.m. Feb. 21 while making her final rounds. The assistant’s court deposition states that she found Barragan on the bed with the resident and observed sexual intercourse.
The resident has severe dementia and is unable to consent to sexual contact, according to the District Attorney’s Office.
As of Wednesday, Sept. 23, the District Attorney’s Office said the case had been adjourned to Tuesday, Oct. 6.
