NORTH SALEM, N.Y. - A Bronx man was charged with felony driving while intoxicated after New York State Police said they found an 11-year-old child in his vehicle during a traffic stop early Saturday morning on Interstate 684 in North Salem.
According to State Police, troopers assigned to the Somers barracks stopped a vehicle traveling southbound on I-684 at about 3:20 a.m. on Aug. 2 after observing a violation of the New York State Vehicle and Traffic Law.
Police identified the driver as Jonathan Danilo Burgos Pua, 33, of the Bronx. During the stop, troopers said Burgos Pua exhibited signs of intoxication and was asked to perform standardized field sobriety tests.
Following an investigation, troopers determined that an 11-year-old child was in the vehicle at the time of the stop. Burgos Pua was taken into custody and transported to the State Police barracks in Somers for processing, where he submitted to a chemical breath test that police said measured a blood alcohol content of 0.09%.
The child was safely released to a sober third party, according to police.
Burgos Pua was charged with aggravated driving while intoxicated with a child passenger under Leandra's Law, a Class E felony, as well as driving while intoxicated with a blood alcohol content of 0.08% or more and driving while intoxicated, both unclassified misdemeanors.
He was issued traffic tickets directing him to appear in North Salem Town Court on Aug. 24.
