Correction: Mahopac man charged with felony DWI under Leandra’s Law

Correction: The original version of this story cited the New York State Police’s allegation that the driver, Anthony T. Mercado, had three children in his car at the time of his arrest for DWI. NYSP subsequently amended its report with the following correction and apology:

“Only one 9-year-old child was present in the vehicle at the time of the stop. State Police apologize for earlier reporting error.”

A Mahopac man was arrested March 15 and charged with driving while intoxicated with a child in his vehicle on the Taconic State Parkway in Yorktown, according to New York State Police.

Troopers from the State Police barracks in Stormville stopped a northbound vehicle at about 9:59 p.m. for alleged violations of state vehicle and traffic law.

Police identified the driver as Anthony T. Mercado, 34, of Mahopac. During the stop, troopers said Mercado displayed signs of intoxication and failed standardized field sobriety tests.

Further investigation determined that a child was in the vehicle at the time of the stop, police said.

Mercado was taken into custody and transported to the Stormville barracks for processing, where he submitted to a chemical breath test that registered a blood alcohol content of 0.12 percent, according to police. The legal limit is 0.08 percent.

The child was released to a sober third party.

Mercado was charged with aggravated driving while intoxicated with a child passenger under Leandra’s Law, a class E felony, as well as driving while intoxicated and additional vehicle and traffic law violations.

He was issued citations directing him to appear in Yorktown Justice Court on April 15.
