SOUTH SALEM, N.Y. - A 27-year-old New York City man was arrested after New York State Police allegedly found him intoxicated in a vehicle parked on the shoulder of Interstate 684 in Lewisboro with a 1-year-old child inside.
According to New York State Police, troopers from the Somers barracks conducted a welfare check at about 4:35 a.m. on June 28 after discovering a Jeep parked on the highway shoulder.
Police said the driver, identified as Yordi Silverio Marte Brito of New York City, exhibited signs of intoxication during the investigation. Troopers administered standardized field sobriety tests before taking Marte into custody.
Police said further investigation determined that a 1-year-old child was in the vehicle at the time. The child was safely released to a sober third party.
Marte was transported to the State Police barracks in Somers, where he submitted to a chemical breath test that allegedly measured a blood alcohol content of 0.08%, according to police.
He was charged with aggravated driving while intoxicated with a child passenger under Leandra's Law, a Class E felony, as well as driving while intoxicated with a blood alcohol content of 0.08% or more and driving while intoxicated, both unclassified misdemeanors.
Marte was issued appearance tickets directing him to appear in Lewisboro Town Court on July 20.
