SOMERS, N.Y. - A Somers man has pleaded guilty to felony charges after admitting to sharing videos containing child sexual abuse material through a social media platform, according to the Westchester County District Attorney’s Office.
Andrew J. Giannetta, 34, pleaded guilty on March 10 to two counts of promoting an obscene sexual performance by a child, both class D felonies, District Attorney Susan Cacace announced Wednesday.
Sentencing is scheduled for April 9 before Acting State Supreme Court Judge Robert Prisco.
According to prosecutors, Giannetta admitted sharing two video files depicting young children engaged in sexual conduct using the social media application Kik. One of the files, shared on or about Jan. 4, 2021, depicted an apparent child between the ages of 8 and 10. A second file, uploaded on or about Nov. 22, 2023, depicted an apparent child between the ages of 3 and 6.
The case originated with a CyberTipline report submitted to law enforcement by the National Center for Missing and Exploited Children in February 2024. The report alerted authorities to suspected child sexual exploitation material being shared through a social media platform.
An investigation by the New York State Police Bureau of Criminal Investigation in Somers, working with the Troop K Computer Crimes Unit as part of the Internet Crimes Against Children Task Force, identified Giannetta as a suspect.
Investigators executed a search warrant at Giannetta’s residence and seized multiple electronic devices for forensic analysis. Following the review of evidence and consultation with the Westchester County District Attorney’s Office, Giannetta was arrested on Nov. 26, 2025.
Cacace said her office remains committed to prosecuting crimes involving the exploitation of children.
“Offenders who target children will be prosecuted with every resource at my office’s disposal, ensuring that underage victims remain protected from further harm and that dangerous predators are not able to reoffend,” Cacace said in a statement. “My office works collaboratively with all of our law enforcement partners to combat these heinous crimes, and I want to thank the New York State Police for their investigatory work on this case in particular.”
The case is being prosecuted by Laura Forbes, chief of the District Attorney’s Child Sexual Abuse Material Bureau.
